JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-09-2019 Heard learned counsels for the petitioner and the State. The petitioner, being the brother of the husband of the daughter of the informant has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 304B and 498A of the IPC.

The prosecution case is that the daughter of the informant was killed by all the accused persons including the petitioner after three years of the marriage for non-fulfillment of the further dowry demand.

Learned counsel for the petitioner submits that the husband of the victim has been acquitted, vide judgment and order dated 06.05.2019, passed by the learned Additional Sessions Judge-V, Araria in Sessions Trial No. 480 of 2016.

Considering the fact that earlier prayer for anticipatory bail

Patna High Court CR. MISC. No.51460 of 2019(2) dt.04-09-2019 2/2 of the petitioner was rejected, vide order dated 17.10.2016, passed in Cr. Misc. No. 40248 of 2016 and the petitioner has renewed his prayer for anticipatory bail in the year 2019, this Court is not inclined interfere.

Accordingly, prayer for anticipatory bail of the petitioner is rejected.

However, learned Court below may consider the prayer for regular bail of the petitioner, if he surrenders within a period of six weeks, in connection with Sikty P.S. Case No. 25 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Araria, keeping in view that the husband of the victim has been acquitted.
