The petitioner being the husband of the complainant is languishing in custody since 27.01.2016 in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 147, 498A, 323 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of dowry demand. It is submitted by the learned counsel for the petitioner that petitioner is making payment of Rs.5151/- per month in pursuance to the order made by the learned court below in Maintenance proceeding since 09.07.2012.
Patna High Court Cr.Misc. No.8492 of 2016 (2) dt.19-02-2016 It is submitted by the learned counsel for the complainant that petitioner evaded to appear as the complaint was filed in 2006.
Considering the fact that the petitioner is an Army Personnel and making payment of maintenance amount, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Complaint Case no. 664 of 2006.
