JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with P.S. Bihar P.S. Case No. 196 of 2015, registered under Sections 324, 307, 353, 504, 506/34 of the Indian Penal Code and Section 25(1-b)a, 27/35 of Arms Act.

The accusation is that on receiving the complaint by Gita Devi, sister in law of the petitioner about committing misbehave by the petitioner and her husband, when the Police reached at the house then husband of the petitioner Dilip Sao started firing anyhow, Police entered into the house and apprehended the petitioner as well as her husband Dilip Sao. On search, two loaded country made pistol and 51 pieces of live

Patna High Court Cr.Misc. No.9046 of 2016 (2) dt.18-03-2016 2/2 cartridges were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that, in fact, the petitioner is wife of co-accused Dilip Sao against whom the allegation of firing was made, when the Police had come due to complaint of Gita Devi, sister in law of the petitioner. The petitioner is in custody since 01.05.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 196 of 2015 (S.T. No. 387 of 2015).
