Petitioner is languishing in judicial custody since 01.04.2017 in connection with Gopalpur P.S. Case No. 26/2017 for offences punishable under Sections 304-B, 120-B of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that her daughter was married six years back with one Mansur Gaddi and the petitioner, who is the bhainsur, along with husband and other family members used to torture her and since the said Mansur Gaddi had a love affair with his bhabhi, all the accused persons including the petitioner have killed her daughter.

No.28789 of 2017 (3) dt.16-08-2017 2/2 It has been submitted by the learned counsel for the petitioner that he is innocent, general and omnibus allegation has been levelled against him and that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Gopalpur P.S.
