The petitioner, apprehending his arrest in connection with Ara Muffasil P.S. Case No. 263 of 2014 registered for the offences punishable under Sections 420, 409, 272, 273/34 of the Indian Penal Code, seeks the privilege of pre-arrest bail. It is submitted that the name of the petitioner has come in the confessional statement of co-accused Dhani Rai and nothing has been recovered from conscious possession of the petitioner or from his house but he is apprehending his arrest. The learned A.P.P. after going through the F.I.R. fairly submits that the name of the petitioner has been taken by the coaccused.
Patna High Court Cr.Misc. No.30097 of 2014 (2) dt.16-01-2015 In the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Muffasil P.S. Case No. 263 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
