This is an application for bail in connection with Laxmipur P.S.Case No. 56 of 2017 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25(1-B)(a), 26, 35 of the Arms Act, including 3/4 of Explosive Substance Act.
Petitioner is named in the FIR and prosecution story is that on chase he was arrested and from his possession of country made bomb was recovered.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case as he was passing through jungle and he was caught and he is in custody for three months having no criminal antecedent.
Patna High Court Cr.Misc. No.30061 of 2017 (3) dt.21-07-2017 2/2 Heard learned APP also.
Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after framing of charge in this case.
With the above observation, this application is dismissed.
