JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 2958 of 2012 instituted for the offences under Sections 323, 341, 379, 504, 406 of the Indian Penal Code.
The complainant is said to have given Rs. 65,000/- in installments to the brother of the petitioner for purchase of a plot of land and the petitioner also is said to have signed on some documents towards handing over of money in lieu of transfer of a plot of land. Later, the land was not transferred nor the money was returned. The petitioner is also alleged to have divested the complainant of his belongings when he had

Regard being had to the nature of accusation and the fact that the money had been paid to the brother of the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Complaint Case No. C-2958 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
