The petitioner seeks bail in connection with Balrampur (Telta) P.S. Case No. 26 of 2019, registered for offence punishable under Sections 363/366(A)/506/34 of the Indian Penal Code and later on Section 4 of POCSO Act has been added.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that there is inordinate delay of a week in lodging FIR without plausible explanation and there is contradiction in the statement of victim recorded under Section 161 Cr.P.C and 164 Cr.P.C. He further submits that there is no evidence/medical report to connect the
Patna High Court CR. MISC. No.51193 of 2019(4) dt.18-11-2019 2/2 petitioner in the alleged occurrence. The petitioner has no criminal antecedent and he is in custody since 11.04.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, Katihar in connection with Balrampur (Telta) P.S. Case No. 26 of 2019.
