ANJANA PRAKASH ORAL JUDGMENT Date: 17-03-2016 The Petitioner seeks revision of the judgment of conviction dated 19.1.2016 passed by the Additional Sessions Judge Vth, Saran at Chapra in Criminal Appeal No.113 of 2014, by which he has upheld the conviction of the Petitioner u/s.498A I.P.C. and maintained the sentence of six months R.I. and fine of Rs.1000/-, in default of which simple imprisonment for another ten days, passed by a judgment dated 10.12.2014 by the S.D.J.M., Saran in Trial No.1071 of 2014 arising out of Complaint case No.4367 of 2009. Having gone through the impugned judgment, I do not find any reason for interference. However, considering the period of custody of the Petitioner, the sentence is modified to the period already undergone by him. However, he is required to deposit the fine
Patna High Court CR. REV. No.181 of 2016 dt.17-03-2016 2/2 as directed by the Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.
With the aforesaid modification in sentence, the revision application stands dismissed.
