The petitioner apprehends his arrest in connection with Excise Case No.401 of 2019 registered under Section 30(c) of the Bihar Prohibition and Excise Act, 2016 and Sections 2(e), 3, 5 and 13 of the Mahua Flower Act, 2006.

The accusation is of recovery of 360 kilograms Mahua flower from the house of the petitioner. Learned counsel for the petitioner submits that it would appear from the prosecution report that the petitioner was not apprehended on the spot. It has further been submitted that the alleged recovery was made from the joint family house of

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Excise Judge, Gaya, in connection with Excise Case No.401 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
