JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the accusation that he along with one FIR named accused Sumit Chouhan kidnapped the informant and confined him in a hut and also assaulted him as well as snatched his mobile but informant got opportunity to elude from the clutches of the petitioner and raised alarm which attracted the villagers and thereafter, police came there and petitioner and co-accused, Sumit Chouhan were arrested whereas rest persons managed to escape from there. Petitioner carries criminal antecedent of some cases but there is nothing in the entire written report of the informant or in the impugned order that any demand of ransom had been made.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of A.K. Dixit, learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Gaighat P.S. Case No. 299 of 2015. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
