JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 The petitioner is apprehending his arrest in connection with Mahua P.S. Case No. 297 of 2015, registered for offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

Allegation against the petitioner and others is of kidnapping the minor daughter of the informant. It has been submitted on behalf of the petitioner that prosecution case is false and concocted and the girl has gone out of her own sweet will and married with the petitioner and out of the said marriage, they also have a daughter and the girl has also given a petition in this regard, which is at annexure -5. Heard learned A.P.P. also.

No.32527 of 2018 (2) dt.28-06-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of six weeks and make prayer for bail and the court below at the time of hearing shall call upon the victim girl so as to verify the averments made in Annexure -5 and if the same is found to be true, he will release the petitioner on bail otherwise, he is free to pass any order, he deems fit and proper.
