2. Learned counsel for the petitioner is directed to make necessary correction in Para-4 of the instant bail petition in course of the day.

3. The petitioner seeks bail in connection with Goraul (Kathara O.P.) P.S. case No. 50 of 2020 instituted for the offences under Sections 363, 366(A), 34 of the Indian Penal Code.

4. Prosecution allegation, in short, is that the daughter of the informant went to see Saraswati Puja but did not return home. The Informant and his family members started searching but, they did not succeed. On the next morning, they came to

Patna High Court CR. MISC. No.55615 of 2025(2) dt.22-08-2025 2/3 know that her daughter was seen with co-accused Chandan Kumar (son of the petitioner). It is alleged that this petitioner along with other co- accused person kidnapped the daughter of the informant.

5. It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.12.2024 and has no criminal antecedent. The petitioner has falsely been implicated in the present case merely on suspicion as he happens to be the father of the main accused Chandan Kumar. Learned counsel for the petitioner submits that general and omnibus allegation has been made against the petitioner. There is no direct or specific allegation of any overt act is alleged against the petitioner rather the specific allegation of kidnapping the Informant's daughter is against the co-accused Chandan Kumar. Learned counsel for the petitioner further submits that the co-accused Kundan Kumar @ Kundan Ram has already been granted bail by this Court vide order dated 04.12.2023 passed in Cr. Misc. No. 76778 of 2023.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature.

7. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the

Patna High Court CR. MISC. No.55615 of 2025(2) dt.22-08-2025 3/3 petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Goraul (Kathara O.P.) P.S. case No. 50 of 2020.
