JUSTICE RAKESH KUMAR ORAL ORDER 22-06-2016 Heard Sri Soban Asghar, learned counsel for the petitioner, Sri Narsingh Tanti, learned A.P.P. as well as Sri Deepak Kumar, learned counsel who has voluntarily appeared on behalf of the informant.
This is second attempt for grant of bail on behalf of the petitioner. Earlier, in view of seriousness of accusation as well as the fact that trial was at the fag end, prayer for bail of the petitioner was rejected. In the present petition by order dated 11.5.2016 a report was called for from the court below regarding the stage of the case, which has been received and kept at flag 'A'. The report indicates that till the date of the report 11 prosecution witnesses were already examined. However, in the meanwhile, from the defence side a petition was filed for reexamination of the victim. It appears that only with a view to
Patna High Court Cr.Misc. No.16642 of 2016 (3) dt.22-06-2016 2/2 linger the trial such petition has been filed. However, without recording any opinion on such fact, I do not find any ground to review my earlier order.
The prayer for bail again stands rejected.
