2. In this case, the petitioner is seeking regular bail in connection with Simari P.S. Case No. 230 of 2024, registered for the offences punishable under Sections 366A, 504, 506/34 of the IPC and sections 8/12 of POCSO Act.

3. As per allegation, the sister of the informant went to market, but she didn't return. When the informant went to the house of petitioner to inquire about her sister, the family members of the petitioner abused her and ousted her from her house.

4. The learned counsel for the petitioner has

Patna High Court CR. MISC. No.63356 of 2024(2) dt.12-09-2024 2/2 submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. The petitioner is under custody since 30.06.2024.

5. From perusal of the order of the learned court below, it appears that the statement of the victim was recorded under Section 164 of the Cr.P.C. and she has stated that she fled away with the petitioner with her own sweet will.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-VIcum-Special Judge, POCSO, Buxar in connection with Simari P.S. Case No. 230 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
