The petitioner apprehends his arrest in Jagdishpur P.S. Case No.257 of 2017 registered under Section 394 of the Indian Penal Code.
The informant, Jitendra Singh, Nozzleman of M/s Suman Suresh Fuel Station alleged that he was talking to his wife, sitting on a magic vehicle parked at fuel station, but three persons came on Apache motorcycle and committed robbery. The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner figured in the case in the confessional statement of co-accused, Pappu Yadav @ Pappu Singh. Save and except the confession, there is no material against the petitioner but it appears that it is a case of robbery in which the informant and other witnesses
Patna High Court CR. MISC. No.50824 of 2019(2) dt.17-08-2019 2/2 have claimed to identify the accused during the course of investigation on T.I.P.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below, learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced by the order of this Court.
