====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-01-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in case registered for the offences punishable under Sections 420, 406, 467, 468, 471, 120B of the Indian Penal Code.
3. As per prosecution case, these petitioners along with other accused persons have committed fraud by taking Rs. 12 lacs from the informant for procuring employment in Military Engineering Services from the students of informant's coaching institute.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case due to land
Patna High Court CR. MISC. No.58677 of 2024(3) dt.10-01-2025 2/2 dispute between the parties. He further submits that during course of investigation, police has found involvement of the informant in the alleged offence and he has also been made accused in this case. As per F.I.R., entire alleged occurrence took place in year 2018 and this case has been lodged after inordinate delay of two years without any plausible explanation.
5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioners are named in the F.I.R. and there is direct allegation that they received money from the informant to provide employment in Military Engineering Services from the students of informant's coaching institute
6. Considering the nature of accusation, prayer for anticipatory bail of the petitioners are refused. (Prabhat Kumar Singh, J) Navya/- U T
