Civil Writ Jurisdiction Case No.11201 of 2015 ====================================================== Ashok Mahto .... .... Petitioner/s
Versus
The State of Bihar & Anr .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : Mr. Raj Bansh Dubey For the Respondent/s : Mr. Ashok Kumar Keshri ====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 28-04-2016 Heard the learned counsel, Mr. Rudal Singh for the petitioner.
By the impugned order dated 20.05.2015, the learned Principal Judge, Family Court, Muzaffarpur has directed the petitioner to pay monthly maintenance of Rs.3,000 under Section 24 of the Hindu Marriage Act in Matrimonial Case No.194 of 2014.
From perusal of the impugned order, it appears that Court below found that in spite of sufficient income, the petitioner is neglecting to maintain the wife and, therefore, directed to pay Rs.3,000 per month.
Considering the day to day expense in these days, in my opinion, the learned Court below has rightly passed the order and, therefore, in supervisory jurisdiction under Article 227 of the Constitution of India, this Court cannot hold panchayati to reduce
Patna High Court CWJC No.11201 of 2015 (2) dt.28-04-2016 the maintenance.
Accordingly, this writ application is dismissed. (Mungeshwar Sahoo, J) Saurabh/- U T
