ANJANA MISHRA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Nautan (Jagdishpur) P.S. Case No.216 of 2016 for allegedly having committed the offence under Sections 406, 420, 506 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.

Considering the fact that the cheques, which are purported to have been returned for want of adequate funds, have already been encashed and/or lost by the petitioner, which is evident from the Bank statement (Annexure 2 series to this application), which places the F.I.R. under a cloud, let

No.27628 of 2017 (3) dt.18-07-2017 2/2 the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, West Champaran at Bettiah, in connection with Nautan (Jagdishpur) P.S. Case No.216 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
