JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and two other persons are named in the first information report whereas four to five persons are not named. The informant claims that in the night of 25.4.2015 when her husband did not return and she came out of the house in search of her husband, she saw petitioner and above stated persons assaulting her husband and at that time all the aforesaid persons were armed with sharp edged weapons. Moreover, the informant further stated that she ran towards her home out of fear but she became unconscious and when in the morning of 26.04.2015, she got her consciousness, she again went in search of her husband and found the dead body of her husband in a field.

No.10097 of 2016 (2) dt.03-02-2016 2/2 The contention on behalf of the petitioner is that neither the informant nor any other witness is an eye witness of the alleged occurrence and, as a matter of fact, the informant's husband was killed by some unknown persons but due to village politics , the informant has lodged this case against the petitioner and others.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bhawanpur P.S.Case No. 75 of 2015.
