JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Ishuapur P.S. Case No. 16 of 2014 dated 06.03.2014 instituted for the offences under Sections 328, 302, 201/34 of the Indian Penal Code.
The son of the informant was found dead in the field somewhere near his house. Later, it transpired that the death was because of consumption of aluminum phosphide, a dangerous substance.
The allegation in the F.I.R. is that the deceased had gone outside his village along with the petitioner but never came back. The dead body was found by the informant/father of the deceased lying in the field. Merely because the deceased had gone out of his village home along with the
Patna High Court Cr.Misc. No.32220 of 2018 (2) dt.29-06-2018 2/2 petitioner, he has been suspected for having played foul with the deceased.
There is no material in the entire investigation report to connect the petitioner with the crime.
Finding the case to be based purely on suspicion, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Saran at Chapra in connection with Ishuapur P.S. Case No. 16 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
