The petitioner claims to have retired on 31.01.2013 from the Basantpur Branch Bank, District- Siwan, however, it is contended that gratuity, leave encashment etc. have not been paid along with the arrears of salary.
A counter affidavit has been filed on behalf of the Bank stating that the payments are being made head-wise according to the chronological order. Several orders have been appended by the Bank. It is also contended that gratuity amount has been paid to the
Patna High Court CWJC No.190 of 2016 dt.19-05-2016 2/2 employees who have retired up to March, 2013 but it is contended that the same could not be paid to the petitioner as he has furnished indemnity bond etc. in the month of May, 2016 only. Be that as it may, since the petitioner's claim has matured for payment of gratuity even in view of the orders passed by this Court considering the chorological order, this Court would direct the Bank authority to make payment of gratuity amount to the petitioner within a period of one month from the date of receipt/production of a copy of this order.
So far other dues are concerned, they should also be paid to the petitioner according to chronological order and whenever his term will come that has to be communicated by the Bank to the petitioner that what amount has become matured for its payment.
