The instant petition has been filed for grant of regular bail in connection with special case no. 02 of 2016 arising out of Alauli Town PS case no. 62 of 2016 registered for the offences punishable under Sections 17/18 N.D.P.S. Act. The allegation is with regard to petitioner being the owner of the land who had given the land on batai to one Jahru Bind and thereafter, upon a raid being conducted by the police, it was found that the said Jahru Bind was cultivating opium. Learned Senior counsel for the petitioner submits that petitioner is merely the owner of the land and has not actually cultivated the opium. He further submits that the petitioner is the

It is also stated that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, I find it a fit case where the petitioner may be released on bail.
Accordingly, the abovenamed petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Special Judge, Khagaria in connection with special case no. 02 of 2016 arising out of Alauli Town PS case no. 62 of 2016.
