JUSTICE SANJAY PRIYA ORAL ORDER 22-06-2017 Heard learned counsel for the petitioners and the State. The petitioner seeks bail in Ara Muffasil (Dhobhahra Out Post) P.S. Case No. 297 of 2016 instituted for the offence under Section-306 & other minor sections of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he is in custody since 13-12-2016. There is no specific allegation of overt act against the petitioner. As per written report, this petitioner along with other accused persons came to the house of the informant and raised suspicion against the character of sister of the informant, on account of which, the sister of the informant committed suicide inside the house.
The C.D. has been received.
Patna High Court Cr.Misc. No.20366 of 2017 (4) dt.22-06-2017 2/2 The learned APP has submitted that the doctor has found in the postmortem report, the cause of death as asphyxia due to hanging.
In such circumstances, as per written report itself as well as postmortem report, death has been caused due to hanging. There is no allegation of specific overt act against the petitioner. In such circumstances, prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ara Muffasil (Dhobhahra Out Post) P.S. Case No. 297 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur subject to condition that both the bailors should be close relatives of the petitioner.
