The petitioner apprehends his arrest in connection with Pasraha P.S. Case No. 49 of 2019, registered under Sections 366(a)/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Khagaria. The accusation is that in the evening of 04.05.2019 sister of the informant aged about 17 years had gone to attend call of nature, but she was kidnapped by the four persons named in the F.I.R. including the petitioner in course of returning to her house by boarding her on the motorcycle. Learned counsel appearing on behalf of the petitioner submits that, in fact, sister of the informant left her house according to her sweet will due to love affairs with the

Further submission is that the statement of victim has been recorded in which she stated that petitioner has kidnapped her. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
