JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and according to the prosecution case itself, the marriage of petitioner had taken place with the deceased 17 to 18 years ago and on the alleged date of occurrence, it was petitioner, who gave information to the informant regarding the death of the deceased. Moreover, in course of investigation, it came to light that prior to her death, deceased had a quarrel with the petitioner and after that, she committed suicide.

The contention on behalf of the petitioner is that the deceased was suffering from mental disorder since long and under

Patna High Court Cr.Misc. No.10072 of 2016 (2) dt.03-03-2016 2/2 depression, she committed suicide.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Dehri, Rohtas in connection with Chutia P.S.Case No. 13 of 2015.
