The petitioner seeks bail in Narpatganj P.S. Case No. 99 of 2020, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, co-accused Kamil inflicted farsa blow causing injury on the head of Tashim whereas petitioner inflicted arrow blow which caused injury on the face of Tashim.

It is submitted on behalf of the petitioner that as per the FIR two persons are alleged to have assaulted Tashim, but only one injury has been found by the doctor. Further submitted that there is long standing land dispute between the parties due to which petitioner has falsely been implicated in this case. Informant is cousin brother of petitioner. Petitioner is in custody since 16.09.2021.

Patna High Court CR. MISC. No.65235 of 2021(2) dt.24-02-2022 2/2 Counsel for the informant vehemently opposed the prayer for bail and submitted that there is specific allegation against this petitioner of inflicting arrow blow causing piercing injury which has been found to be grievous in nature. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 99 of 2020.
