====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 27-08-2025 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Bhelahi Police Station Case No. 44 of 2024, disclosing offences under Sections 80 and 3(5) of B.N.S.

3. The prosecution case, as per the First Information Report, the daughter of the informant was married to coaccused Munna Patel on 15.05.2023 and after the marriage, the husband and the family members of husband of the deceased, started demanding dowry and due to non-fulfillment of demand, the deceased was killed in her matrimonial home on 12.11.2024.

4. Learned Counsel for the petitioners submit that

Patna High Court CR. MISC. No.55309 of 2025(2) dt.27-08-2025 2/3 petitioners are distant family members of the deceased husband. The allegation of demand of dowry is against the husband and his father and mother in the First Information Report. The petitioner no. 1 is cousin brother-in-law and petitioner no. 2 is cousin mother-in-law of the deceased. Learned counsel further submits that own mother-in-law and father-in-law along with husband of the deceased have been specifically named in the FIR. Learned counsel next submits that no specific role has been assigned to the petitioners in the FIR. Learned counsel further submits that the husband of the petitioner is in custody as stated in para 8 of this application.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that petitioners are distant family members of the deceased and having no specific allegation of demand of dowry against the petitioner in the FIR, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like
