JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Sitamarhi P.S. Case No. 01 of 2015 registered under Sections 302/34 of the I.P.C. and section 27 of the Arms Act. Later on, sections 120(B) and 212 of the I.P.C. were added.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, co-accused Ravi Patel has disclosed the name of the petitioner showing his involvement in the present case. Except that, there is nothing against the petitioner. It is also submitted that petitioner is in custody since 03.02.2015. Further submission is that Ravi Patel has already been allowed bail by a

Patna High Court Cr.Misc. No.9501 of 2016 (3) dt.28-04-2016 2/2 Bench of this Court vide Cr. Misc. No. 26307 of 2015 on 27.07.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Sitamarhi in connection with Sitamarhi P.S. Case No. 01 of 2015. Out of two sureties, one surety must be parents/close relatives of the petitioner.
