Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The Petitioner is apprehending his arrest in a case registered for the offences punishable u/s 413 and 414 of the Indian Penal Code.

As per the prosecution case, during the course of checking of vehicles, the co-accused Khomari Sah boarded on a motorcycle with no registration number came. On being asked, he has stated that the said motorcycle is of the co-accused Shubh Narayan Ram which was stolen from Narayanpur and we

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. He has submitted that the name of the petitioner has transpired in the confessional statement of the co-accused Khomari Sah. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.

Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, East Champaran, Motihari in connection with Chiraiya P.S. Case No. 81 of 2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure. The application stands allowed.
