JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2018 The petitioner is apprehending his arrest in connection with Bihar P.S. Case No. 605 of 2015, registered for offences punishable under Sections 341, 323, 324, 307, 504, 506, 379, 384 & 341 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is that he assaulted the informant on the head by rod.
It has been submitted on behalf of the petitioner that the injuries are simple in nature and as a matter of fact charge-sheet was not submitted against the petitioner. But, later on after investigation cognizance has been taken. It has further been submitted though the petitioner is accused in other 14 cases, he has given an explanation in paras 13 to 20 that all the cases have been filed at the instance of the informant and his family members.
Heard also, learned APP for the State and learned counsel
Patna High Court Cr.Misc. No.32737 of 2018 (3) dt.20-07-2018 2/2 for the informant, they have opposed the bail application by stating that he has criminal antecedents and injuries were on vital parts of the body.
Having heard both sides, in view of the above facts, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Bihar P.S. Case No. 605 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) It is further made clear that the petition in no way shall threaten the informant otherwise the informant may move for cancellation of his bail bonds.
