ANJANA PRAKASH ORAL JUDGMENT Date: 16-07-2015 The Petitioner seeks quashing of the Prosecution on account of delay. A report was called for from the Court below and on perusal of the report I find that it is on account of absence of the Petitioner that the trial is not proceeding.

No doubt the Complainant is also not appearing there possibly for the reason that there is no progress on account of absence of the Petitioner.

In such circumstances, the application is dismissed in connection with Complaint Case No. 646 of pending before the Sub-divisional Judicial Magistrate, Muzaffarpur.

The Petitioner is directed to regularly appear before the Court below.
