JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Supplementary affidavit is filed on behalf of the petitioner giving details of his criminal antecedent. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402, 414 of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.
Petitioner was caught along with some others when allegedly, he along with others had assembled to make preparation for committing dacoity and on being searched, one loaded country-made pistol and one live cartridge were recovered from his conscious possession.
Contention on behalf of the petitioner is that petitioner
Patna High Court Cr.Misc. No.11175 of 2016 (3) dt.28-03-2016 2/2 is in jail custody since 24-09-2015 and so far as criminal antecedent of the petitioner is concerned; earlier two cases had been registered against the petitioner in the year, 2012 as well as 2013 and in both cases, petitioner was granted privilege of bail. It is further submitted that some co-accused, having more or less similar allegation, have already been granted privilege of bail. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Siwaipatti P.S. Case No. 107 of to the satisfaction of Sub Judge-9th-cum-ACJM, Muzaffarpur.
