JUSTICE RAKESH KUMAR ORAL ORDER 14-06-2018 Heard Sri Sabal Kumar Jha, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is a lady and having clean antecedent, which fact has been stated in paragraph no. 3 of the petition , has approached this court with a prayer to grant bail in the event of her arrest or surrender in connection with Lalganj P.S. Case No. 159 of 2017 , registered for the offence under Section 272, 273 of the Indian Penal Code, 1860 and Section 30 (A)/32(2)/ 41(1) of the Bihar Prohibition and Excise Act, 2016. It was submitted by learned counsel for the petitioner that save and except the fact that petitioner is the registered owner of the commercial vehicle from which 35 liters of country made liquor was shown to be recovered, there is no other material to connect her in the present case. Patna High Court Cr.Misc. No.33085 of 2018(2) dt.14-06-2018 2/2 argued that without knowledge or consent of the petitioner, driver of the commercial vehicle of the petitioner was carrying country made liquor, which was intercepted and case been instituted.
Considering the nature of accusation, the fact that petitioner is a lady and having clean antecedent, in the event of her arrest or surrender within a period of six weeks from today, let the petitioner - Rajmati Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 2nd Cum Special Judge Vaishali at Hajipur / concerned court in connection with Lalganj P.S.
