2. The petitioner is in custody since 03.12.2016 in connection with Neemchak Bathani P.S. Case No. 144 of 2016 for the offences alleged under Section 498A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

3. It is submitted that the petitioner has been falsely implicated on mere suspicion. The petitioner has been granted bail in earlier case, namely, Neemchak Bathani P.S. Case No. 116 of 2016 in which he is accused. The petitioner expresses his willingness to keep his wife with due dignity and honour.

4. Despite issuance of notice, appearance has not been entered on behalf of the opposite party no.2 nor is she represented when the matter is called.

5. By order dated 01.07.2017, the petitioner has been granted provisional bail.

6. Having regard to the entirety of the facts and circumstances of the case, the provisional anticipatory bail granted

Patna High Court Cr.Misc. No.24791 of 2017 (6) dt.18-10-2017 2/2 to the petitioner by order dated 01.07.2017 by this Court in connection with Neemchak Bathani P.S. Case No. 144 of 2016 pending in the Court of learned Additional Chief Judicial Magistrate-X, Gaya is hereby confirmed.
