JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Shri Raghav Prasad, the learned advocate for the petitioners and learned APP for the State. The petitioners are seeking regular bail in connection with Pachrukhi P.S. Case No. 147 of 2016 for the offences alleged under Sections 304(B)/201/34 IPC.

The petitioners are said to be the mother in law and devar respectively of the deceased. The allegations as contained in the FIR are that of demand of dowry and ill treatment leading to death of the daughter of the informant.

The learned counsel for the petitioners would submit that the petitioner no. 1 is mother in law and petitioner no. 2 is the devar who have nothing to do with the family of the deceased as

Patna High Court Cr.Misc. No.25425 of 2017 (2) dt.07-06-2017 her husband had separate business. Learned counsel for the petitioners has also placed before me a copy of the order dated 15.3.2017 passed by a coordinate Bench of this Court in Criminal Misc. No. 8462 of 2017 in which the father in law, namely, Subhash Manjhi has been granted regular bail. The learned APP opposed the prayer for bail.

However, considering that the petitioners are mother in law and devar of the deceased and the father in law has already been allowed privilege of bail, let the petitioners, namely, (1)Sawari Devi; and (2) Rajendra Manjhi @ Satyendra Manjhi be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, -VI, Siwan in connection with Pachrukhi P.S. Case No. 147 of 2016.
