JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially registered for the offence punishable under Section 379 of the Indian Penal Code and later on, Section 411 of the Indian Penal Code was also added. Petitioner is not named in the first information report but it appears that in course of investigation, he was arrested and some stolen articles are said to have been recovered from the house of the petitioner but admittedly, the recovered articles had not been put on Test Identification Parade. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 06.01.2016.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.10697 of 2016 (2) dt.08-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar-II, Judicial Magistrate, Araria in connection with Raniganj P.S. Case No. 10 of 2016.
