The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 5 litres of country liquor and 100 litres of jawa mahua was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of her antecedent. She is in custody since 25.9.2021 and charge sheet has been submitted in the case. The house in question belongs to joint family. The co-accused who has also having an antecedent has been enlarged on bail.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having criminal antecedent under the Bihar Prohibition and Excise Act, 2016 and recovery of liquor and jawa mahua from the house of the petitioner, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Liberty is granted to the petitioner to renew her prayer for bail on completing one year in custody.
