====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-08-2024 Heard learned counsel for the petitioner and the State.

2. This petition has been filed for modification of order dated 24.07.2024 passed in Cr. Misc. No. 35877 of 2024 to the extent of corrections in the prayer portion and extension of period of surrender.

3. Due to inadvertence in the prayer portion in the main petition, police station has wrongly been typed as 'Hajipur Sadar' in place of 'Hajipur Town' and satisfaction of court below has wrongly been typed as 'Exclusive Special Excise Court No.-1-Cum- Additional District and Sessions Judge, Vaishali at Hajipur' instead of 'Chief Judicial Magistrate, Vaishali at Hajipur'. Same error has occurred in aforesaid order dated 24.07.2024. Accordingly, learned counsel for the

Patna High Court CR. MISC. No.63535 of 2024(2) dt.31-08-2024 2/2 petitioner requests for necessary corrections in the order.

4. In view of the aforesaid submission, let police station be read as 'Hajipur Town' and satisfaction of court below be read as 'Chief Judicial Magistrate, Vaishali at Hajipur' in paragraph No. 5 of aforesaid order dated 24.07.2024 and further four weeks' time from the date of receipt/production of copy of this order is granted to the petitioner to surrender and furnish bail-bond before the court below, subject to deposit of Rs. 5,000/- (Rupees Five Thousand) to the concerned District Legal Services Authority and to furnish its receipt with the bail-bond.

5. Accordingly, modification petition is allowed and order dated 24.07.2024 passed in Cr. Misc. No. 35877 of 2024 is modified to the above extent only.
