26-06-2018 Heard Sri Satish Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Saharsa Sadar P.S. Case No. 396 of 2018 registered for offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

By way of referring to F.I.R., learned counsel for the petitioner submits that nothing was recovered from the house of the petitioner, rather in the case, near the house of the petitioner, recovery of about 5 litres of toddy was shown, whereas, fact remains that petitioner is himself licensee of the toddy. Considering the nature of accusation, in the event of his arrest or surrender within a period of six weeks from today,

Patna High Court Cr.Misc. Sessions Judge 2nd Saharsa-cumSpecial Judge, Saharsa in connection with Special Case No. 178 of 2018 arising out of Saharsa Sadar P.S. Case No. 396 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
