The petitioner is in custody since 06.07.2018 in connection with Sessions Trial No. 15 of 2019 arising out of Rani Talab P.S. Case No. 96 of 2016 for the offence registered under Sections 341, 323, 504, 379, 307/34 of the Indian Penal Code.

Prayer for bail of the petitioner was earlier rejected on 12.10.2018 with liberty to the petitioner to renew his prayer for bail after six months.

Learned counsel for the petitioner submits that the present prayer for renewal is being made on the ground that in the trial, the informant himself has denied the occurrence and has stated that he had fallen down and hurt himself during the

Patna High Court CR. MISC. No.54261 of 2019(3) dt.05-09-2019 2/2 scuffle which ensued in the quarrel that took place between the petitioner and his agnates. He thus, submits that in view of the changed circumstances, the petitioner may be extended the privilege of bail.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent and the informant himself has given a different picture and also the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge - II, Danapur District Patna in connection with Sessions Trial No. 15 of 2019 arising out of Rani Talab P.S. Case No. 96 of 2016.
