The petitioners are apprehending their arrest in connection with Chapra Muffasil P.S.Case no.70 of 2018 , registered for offences punishable under Sections 406, 420 /34 of the Indian Penal Code.
Allegation against the petitioners as per FIR is that the marriage of the son of the petitioner no.1 was fixed with the daughter of the informant and the ring ceremony was held. Rs.3,50,000/- was spent over the same and as there was a death in the family of the petitoiner, he refused to marry at that time and thereafter they have been demanding Rs.10 lac. It is also alleged that they have spent money in engaging the hotels and other places.

No.35088 of 2018 (2) dt.09-07-2018 2/2 Submission of the learned counsel for the petitioners is that the allegation expenditure is false and the petitioner is ready to return the amount but that should be a reasonable amount. Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail.. Having heard both sides and in view of the facts and circumstances, as stated above this application is disposed of with direction to the petitioner to surrender within a period of eight weeks with a draft of Rs.3 lac in favour of the informant and once the bank draft is deposited, the same will be released in favour of the informant and the petitioner shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each Chapra Muffasil P.S.Case no.70 of 2018 dated 16.2.2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
It is made clear that aforesaid amount so deposited, shall be subject to result of the case.
With the aforesaid observation, this application is disposed of.
