JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 of the Indian Penal Code and Sections 25(1-b)a, 26, 27/35 of the Arms Act. Petitioner is in jail custody since 07.09.2015 on the accusation that when police party chased him, he opened fire on the police party but anyhow he was captured by the police party and one country made katta and two live cartridges were recovered from his conscious possession. Petitioner does not have any criminal antecedent and the investigation of this case has already been completed.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.10763 of 2016 (3) dt.14-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arrah in connection with Udwant Nagar P.S. Case No. 243 of 2015.
