Heard the parties.

This application has been filed for modification of the order dated 15.12.2015 passed in Cr. Misc. No. 50601 of 2014. It has has been contended by learned counsel for the petitioner that now the petitioner has arranged the amount of Rs.10,00,000/- which is due to the complainant-opposite party no.2 and he wants time to be extended so that he may deposit the aforesaid amount and execute the bail bond.

The petitioner is granted four weeks' time to deposit the amount which, as per the petitioner, is Rs.10,00,000/-. The court below will verify total amount and if it is found that Rs.10,00,000/- is due, the court below will accept the deposit and grant him on bail. If the amount is more than Rs.10,00,000/- then the bail bond of the petitioner shall be accepted only after deposit of the entire amount. The court below will release the entire amount in favour of the opposite party no.2.

If the entire amount, after verification, is deposited by the petitioner to the satisfaction of the complainant-opposite party no.2 then the entire proceeding of Complaint Case No. 569(C) of 2013 shall be quashed.

With the aforesaid observation, this modification application is disposed of.
