2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 304, 308 , 328 , 201 / 34 of I. P . C . and section 33 , 34, 37, 41 of Bihar Prohibition and Excise Amendment Act, 2018 .

3. As per the prosecution case, informant received an information that some people of different jurisdiction had fallen ill due to consumption of poisonous substance which was supplied by this petitioner and those people died during course of treatment.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating

Patna High Court CR. MISC. No.55860 of 2023(2) dt.29-08-2023 2/2 material has been recovered from the conscious possession of the petitioner and he is no way connected with the alleged occurrence .

5. Learned counsel for the State opposed the prayer for bail and submitted that the specific allegation against this petitioner is that he supplied spurious liquor to the deceased persons, consumption of which led to their death.

6. Considering the aforesaid facts and gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Kaushik/- U T
