The appeal is for grant of bail to the appellant in Parsa P.S. Case No. 189/2016, registered for the offences punishable under Sections 342, 323, 504 and 34 of the Indian Penal Code and sections 3(i)(x) of SC/ST Act and sections 3 and 4 of Prevention of Witchcraft Act.

The gist of the allegation is that the informant alleged that Indradeo Rai called her inside his house and all the accused persons assaulted her making allegation that she is Witch and when her daughter-in-law came to rescue the accused persons also assaulted her and others.

Considering the facts aforesaid and nature of allegation made against the appellant the appeal is allowed, the

Patna High Court CR. APP (SJ) No.1564 of 2017 (2) dt.22-05-2017 2/2 appellant aforesaid is directed to be enlarged on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge SC/ST (POA), Act, Saran at Chapra in connection with Parsa P.S. Case No. 189/2016.
