2. The petitioner seeks bail in connection with Bihiya P.S. Case No. 215 of 2023 registered for the offence punishable under Sections 364 /34 of the Indian Penal Code.

3. The allegation against the petitioner is that he along with other criminals abducted the victim in a car and who was recovered on the next date.

4. The learned counsel for the petitioner has submitted that the petitioner is in jail since 10.10.2023 and F.I.R. has been registered after delay of 26 hours. It appears that there was some dispute between the parties and the informant in his further

No.60887 of 2024(2) dt.04-09-2024 2/2 statement has improved the prosecution story by saying that Rs. 10 lakh was demanded from the informant though the F.I.R. was registered after recovery of the victim and story of demand of Rs. 10 lakh has not been mentioned in the F.I.R.

5. Considering the period of custody and the facts of the case, this application is allowed.

6. Let the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Bhojpur, Ara/concerned Court in connection with Bihiya P.S. Case No.215 of 2023.

7. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance in Jagdishpur Police Station, Distt- Bhojpur, on first and last Sunday of every month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
