Petitioner seeks bail in a case registered under sections 399, 402, 412 and 120B of the Indian Penal Code.

One mobile is said to have been recovered from conscious possession of the petitioner when he along with others assembled to make preparation for committing dacoity.

No doubt, firearms were recovered from other accused but it is unbelievable that a person would go for committing dacoity without any weapon.

Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 28.10.2015. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial
