This application for anticipatory bail arises out of Mohania P.S. Case N0. 521 of 2018, disclosing offences under Sections 147,149,353,379,511,337 of the Indian Penal Code.

From the First Information Report, it appears that allegedly the police were making an attempt to arrest the petitioner, who was an accused in Mohania P.S. Case No. 434 of 2018. It is alleged that the petitioner managed to flee away from his house and his family members and others obstructed the police from due discharge of their official duties and went to the extent of harming the police personnel physically. At the same time, it is alleged in the First Information Report that the petitioner was also instigating people against the police men on duty.

No.50832 of 2019(22) dt.16-08-2019 2/2 Learned counsel for the petitioner has submitted that there is one more case registered against the petitioner, in addition to the case, which has been mentioned in paragraph 3 of the application. He has submitted, referring to the First Information Report that there is no allegation of any specific over act against him. Considering the above, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in Mohania P.S. case No.

521 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
