JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402 of the Indian Penal Code.

Petitioner and some others were caught by the police when they had assembled to make preparation for committing dacoity and fire-arms were recovered from their respective possession.

Contention on behalf of the petitioner is that for recovery of fire-arms and other articles, separate cases were lodged and so far as the present case is concerned; the petitioner is languishing in jail custody since 30-11-2015 and prior to the alleged occurrence, petitioner was made accused only in one case

Patna High Court Cr.Misc. No.10710 of 2016 (2) dt.09-03-2016 2/2 i.e. Araria P.S. Case No. 365 of 2013.

Considering the above-said facts and circumstances of the case as well period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jokihat P.S. Case No. 318 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria.
